During the late recess of the Senate I have issued commissions for the following persons & offices, which commissions will expire at the end of this present session of the Senate. I therefore nominate the same persons to the same offices for reappointment, to wit

Dft (DLC: TJ Papers, 119:20630–1); undated, but the absence of Thomas Worthington’s entry indicates that it was prepared after Gallatin’s reply to TJ’s memorandum printed at 26 Dec.; entirely in TJ’s hand; with words in italics, except for the cancellation in angle brackets (see note 6), added by TJ in pencil; perhaps at a later sitting, TJ added the words and abbreviations at the end of most entries, giving the reason for the open position, in a darker ink and often interlined; in the left margin at each entry, TJ later added, in pencil, a check mark and a symbol, not shown above, to organize his subsequent list; with a key to the symbols written by TJ at foot of text, in pencil too faint to discern wholly, but indicating that an “x” appeared by those appointments due to resignation and an “o” by those due to vacancies.

Vice Jeremiah Smith: in the subsequent draft and message to the Senate, TJ dropped Smith’s name and noted that John S. Sherburne was appointed instead of “Edw. St. Loe Livermore, nominatd Feb. 18. but not appointed” (see Document VI).

Consular appointments uncommissioned: TJ learned from Jacob Wagner in an undated memorandum entitled “An additional list of commissions remaining in the Office of the department of State” that commissions for 14 consuls and commercial agents approved by the Senate during the final days of the Adams administration had not been delivered. While the State Department had listed these positions as “vacant,” TJ added in pencil (rendered in italics in the document above) the names of several of those being replaced as midnight appointments (see Vol. 33:173n).

Vice P. F. Dobree: Pierre Frédéric Dobrée, appointed vice consul at Nantes in 1794, died in 1801. President Adams nominated John Jones Waldo as commercial agent at Nantes on 18 Feb. 1801 and the Senate approved the appointment six days later (JEP description begins Journal of the Executive Proceedings of the Senate of the United States … to the Termination of the Nineteenth Congress, Washington, D.C., 1828, 3 vols. description ends , 1:381, 385; Henry Preble to TJ, 23 Oct. 1801). As with many of the consular positions, the list from the State Department (Document III) indicated that this position was “vacant” when TJ appointed Thomas T. Gantt.

TJ consistently rendered George W. Erving as George W. Erwin, and it is so printed in the Senate journal of executive proceedings (JEP description begins Journal of the Executive Proceedings of the Senate of the United States … to the Termination of the Nineteenth Congress, Washington, D.C., 1828, 3 vols. description ends , 1:403).
