26 Nov. 1790. North Carolina’s militia law, which remains in force by the eighth article of the act of cession until repealed or altered by the territory’s legislative authority, assigns a brigadier general to each district. John Sevier and Daniel Smith were the brigadiers for Washington and Mero districts, respectively, at the time the act was passed. Under the ordinance governing this territory, Congress appoints territorial officers above the rank of field officer. He therefore recommends that Sevier be reappointed for the district of Washington because of his “spirit judgement, experience,” and that James Robertson, the colonel of Davidson County, who is “cool, brave and prudent,” be appointed for the district of Mero, both men enjoying the confidence of the people. Daniel Smith is now secretary and would not accept reappointment as brigadier even if it were proper.

On 17 Feb. 1791 Daniel Smith wrote TJ from “William Cobb’s” in the Southwest Territory accepting his commission as territorial secretary “forwarded from your Office,” and reporting that he had taken the requisite oaths and would soon send a copy of the governor’s executive acts (RC in DNA: RG 59, SWT; at foot of text: “Thomas Jefferson Esquire Secretary of State”; endorsed by TJ as received 11 Mch. 1791 and so recorded in SJL; printed in Terr. Papers, iv, 46). John McNairy wrote TJ from the Southwest Territory on 7 Mch. 1791 accepting his commission as territorial judge and reporting that he had begun to discharge his duties but that Peery, reportedly also appointed a judge, “is not come forward, nor have we any information from him” (RC in DNA: RG 59, SWT; at foot of text: “Thomas Jefferson Esquire”; printed in iv, 49; see Vol. 17: 293n). On 1 Sep. 1792 Smith wrote a brief note to TJ from Knoxville transmitting “another report of the acts of Governor Blount in his executive department” (RC in DNA: RG 59, SWT, at foot of text: “Thos. Jefferson Esquire Secretary of State,” endorsed by TJ as received 4 Dec. 1792 and so recorded in SJL; Tr in DNA: RG 76, Yazoo Land Claims; printed in iv, 167).
