Baltimore 8 July 1777

Sir

my last was of the 2d Instant, covering a Return of the Troops forwarded from this place total 1694, since which only a small detachment of my Regt has come in, who are to March to Morrow.

I take the liberty of laying before your Excellency the Inclosed act of Assembly, by which you will find that the Officers of the last Regts orderd by Congress are precluded the priviledge of recruiting in this state;1 in consequence of which, I have orderd the Officers of two Companies in Colo. Nat. Gists Regt left here under my direction, to proceed to Virginia, and Pennsylvania, whose laws I expect are less selfish and Illiberal.2

should Your Excellency Incline to believe my attendance at Camp would be most consistant with the good of the Service, I should be happy to comply with your orders for that purpose. I have the honor to be sir Your Most Obedient Humble Servant

1Gist apparently enclosed a copy of the Maryland general assembly’s act to reinforce the American army, which was passed on 29 June 1777 (see Md. House of Delegates Votes and Proceedings description begins Votes and Proceedings of the House of Delegates of the State of Maryland. June Session, 1777. Being the Second Session of this Assembly. [Annapolis, 1777]. description ends , 16–29 June 1777 sess., 133). Printed in the 3 July 1777 issue of the Maryland Gazette (Baltimore), the act contains a clause saying that “no officer of the United States shall enlist any of the inhabitants of this state in the service of the United States, unless in some one of the battalions from this state, under the penalty of one hundred pounds for each person entitled contrary hereto.”

2Two of the companies of Col. Nathaniel Gist’s Additional Continental Regiment were supposed to be raised in Maryland.
