Albemarle County Circuit Court Order in Jefferson v. John Hudson and Charles Hudson

On motion of the Demandant by his attorney it is ordered by the Court that the Surveyor of this County, do go upon the land in controversy, survey the same, and return five fair plats thereof to this Court—

MS (Albemarle Co. Law Order Book [1809–21], 306); in Alexander Garrett’s hand; in left margin: “Copied”; at head of p. 303 and applying to this entry: “Thursday October 9th 1817 Present the same Judge as on yesterday,” with that judge identified on preceding page as Archibald Stuart.

For TJ’s writ of right, see Philip P. Barbour and William F. Gordon to TJ, 7 Aug. 1816, and note. The land in controversy was the Limestone Survey, a 400-acre parcel along the Hardware River in Albemarle County (TJ to Mary Stith, 7 Mar. 1811, and note).

The court repeated the above order on 12 May 1818. This suit against the brothers John Hudson (d. 1827) and Charles Hudson (d. 1837) remained unsettled and was regularly continued until it was finally stricken from the Albemarle County Circuit Court docket in 1852 (Albemarle Co. Law Order Book [1809–21], 328; [1852–57], 35; Woods, Albemarle description begins Edgar Woods, Albemarle County in Virginia, 1901, repr. 1991 description ends , 231).
