Sir,

Lieut Colonel Croghan arrived here yesterday on furlough from New Orleans by General Jackson, when I gave him a Copy of the Division order, making him a member of the Court for the trial of General Bissell & Colonel Nicholas.1

If the Lieut Colonel, is obliged to go to Nashville under this order, he states, he shall not have time to settle his accounts or visit his friends. He also states, that he has had no furlough during the war—and further states, that he feels some delicacy in being a member of the Court for the trial of Genl Bissell who is Senior Officer of his Regt. He fears too that some of Colonel Nicholas’s friends think he has not a favourable opinion of the Colonel’s military character.2

As there will not be time to Communicate with the secry. of War, I have the honor to enclose copies of the Orders for the Courts Martial, to assemble at New York and at Nashville, together with Colonel Croghan’s letter, and to submit for your direction, whether, Lieut Colonel Lindsay3 shall be ordered as a member of the Court at Nashville, & Lieut Colo. Croghan ordered to New York, thus exchanging two Officers of the same rank.4

To this arrangement there does not appear to be any serious objections—perhaps Lieut Colonel Lindsay might prefer going to New York, but he has been several weeks on furlough, & Lieut Colo. Croghan’s interest would be promoted by the measure. In such case the cause of the exchange would be explained to Lieut Colo. Lindsay, as well as to Genl. Jackson, & the president of the Court Martial at New York.

Lieut Colonel Croghan will remain here for your decision on his application. With perfect respect, I have the honor to be sir, Yr. Obt Sert:

1George Croghan (d. 1849) was commissioned as a captain in 1812; he was given the brevet rank of lieutenant colonel and later, in 1825, awarded a gold medal for his defense of Fort Stephenson in 1813. Daniel Bissell (d. 1833) joined the army in 1792 and rose to the rank of brigadier general by 1814. Robert Carter Nicholas, one of two officers of that name, served as a lieutenant colonel and colonel in the First, Nineteenth, and Seventeenth Regiments of Infantry during the War of 1812 (Heitman, Historical Register description begins Francis B. Heitman, Historical Register and Dictionary of the United States Army, from Its Organization, September 29, 1789, to March 2, 1903 (2 vols.; 1903; repr., Baltimore, 1994). description ends , 1:221, 339, 746).

2Filed with Parker’s letter to JM is a 16 July 1816 letter (2 pp.) from Croghan to Parker, explaining his request to shift his service on the courts-martial of Gen. Daniel Bissell and Col. Robert Carter Nicholas in Nashville to the court-martial of Brig. Gen. Edmund Pendleton Gaines in New York. Also filed with this letter are copies of the general orders for the courtmartial of Gaines (1 p.), and Bissell and Nicholas (2 pp.). On the cover of Croghan’s letter to Parker is JM’s note: “The exchange approved J.M. July 18. 1816.”
