Gentlemen of the Senate

During the late recess of the Senate, I have issued commissions for the following persons and offices, which commissions will expire at the end of this present session of the Senate. I therefore nominate the same persons to the same offices for re-appointment. to wit

Albert Gallatin of Pensylvania, Secretary of the Treasury, vice Samuel Dexter resigned.

Robert Smith of Maryland, Secretary of the Navy, vice Benjamin Stoddert resigned.

Thomas Tudor Tucker of South Carolina, treasurer, vice Samuel Meredith resigned.

Gideon Granger of Connecticut, Postmaster Genl. vice Joseph Habersham resigned.

Silas Lee of Massachusets, Attorney for the district of Maine, vice Daniel Davies appointed to a State office.

The nominations which took place on the 2d. of March, of justices of the peace for the district of Columbia having been thought too numerous, a commission issued to fourteen of those then nominated for Washington county, to wit, Thomas Sim Lee, Daniel Reintzell, Daniel Carrol, Cornelius Cuningham, Thomas Peter, Robert Brent, Thomas Addison, Abraham Boyd, John Laird, John Mason, William Thornton, Benjamin Stoddert, William Hammond Dorsey, & Joseph Sprigg Belt, and to one other, to wit Thomas Corcoran to be Justices of the Peace for Washington county;12 and another commission issued to eleven of those then nominated for Alexandria county, to wit George Gilpin, William Fitzhugh, Francis Peyton, Richard Conway, Charles Alexander, George Taylor, Josiah13 Thompson, Abraham Faw, John Herbert, Cuthbert Powell, and Jacob Houghman, and to four others, to wit, Elisha Cullen Dick, Alexander Smith, Peter Wise junr. & Thomas Darne, to be Justices of the peace for Alexandria county, all of whom are now nominated for reappointment to the same offices.14

RC (DNA: RG 46, EPEN, 7th Cong., 1st sess.); with “agd.” written by a Senate clerk in the left margin by each entry except the final nominations of justices of the peace for the District of Columbia; in the nomination of the Columbia justices of the peace, a mark, in pencil, appears above the names of Lee, Laird, Stoddert, Dorsey, Fitzhugh, Conway, and Darne, probably inserted by a Senate clerk after receiving TJ’s message to the Senate of 5 Apr. PrC (DLC: TJ Papers, 119:20632–5); with two emendations by TJ in ink (see notes 6 and 13). Dft (DLC: TJ Papers, 119:20628–9); entirely in TJ’s hand; with variation in placement of four consecutive entries (see note 11 below); emendations added by TJ at a later date (see notes 6, 13 and 14 below). Recorded in SJL with notation “nominations. general list.”

Congress had been in session for almost a month when Meriwether Lewis delivered TJ’s message on interim nominations to the Senate on 6 Jan. On 7, 12, 18, and 21 Jan., the Senate considered the nominations. On 22 Jan., the Senate postponed until the 26th, a motion to advise and consent to the nomination of James Linn (Lynn), who had received his appointment, the Federalists charged, as a reward for casting his vote for TJ, not Burr, thus keeping the New Jersey delegation in the House of Representatives from supporting the New Yorker for president. On the appointed day, the motion passed the test vote, 16 yeas to 14 nays. The Senate then passed a resolution consenting to the appointment of Linn. After agreeing to the nominations of Ephraim Kirby and Alexander Wolcott, they consented to all of the others except to those of justices of the peace for the district of columbia. On 5 Apr., TJ informed the Senate of changes in the nominations of the justices of the peace. He noted that Laird’s name had been “inserted by mistake” for that of Benjamin More. He withdrew Laird’s name and nominated More, who had already been commissioned and qualified as a justice of the peace. For other changes, see TJ to the Senate, 7 Apr. On 27 Apr., the Senate consented to TJ’s new nominations and then to the justices included in the nominations of 6 Jan.
