John Jay’s Draft of the Justices of the Supreme Court to George Washington

Ph[iladelphi]a. 20 July 1793

Sir

we have taken in ^to^ Consideration the Letter written to us ^by your Direction^ on the 18 Inst. by the Secy of State. The Question “whether the public may with propriety be availed of the advice of the Judges on the Questions alluded to,” appears to us to be of much magnitude Difficulty as well as Importance: and as it respects our ^affects the judicial^ Department, we feel a Reluctance to decide it without the advice & participation of our absent Brethren—-

We are persuaded that from our being convened

The occasion which induced our being convened is doubtless urgent— of the Degree of that urgency we cannot judge and consequently cannot propose that the Answer to this Question be postponed untill the sitting of the Sup[reme] Court

We are not only disposed but desirous being instrumental ^to be promote^ to the Welfare of our Country in every way that may be consist with our official Duties— we are pleased ^Sir^ with every opportunity of manifesting our Respect for you, and we personally ^personally^ regret every Restraint Obstacle which may restrain us from are sollicitous to do whatever may be ^in our power^ proper to render your Administration as easy & agreable to yoursf. as ^it^ is to your ^our^ Country If further Delay sho Circumstances shd. forbid further Delay, we wish to recieve some of the Questions will ^immediately^ resume the Consideration of the Question and decide it—1 We have the Honor to be with perfect Respect Sr. yr. most obt. & most hble Servt.
