From James Madison to William Davies, 5 April 1804 (Abstract)

§ To William Davies

5 April 1804, Department of State. “I return the deposition received from you some time ago,1 charging one Spinks as a Citizen of the United States with engaging himself as an Officer on board a British Lettre of Marque. It would be adviseable that you should transmit it to the District Attorney, and on Spinks return advise him of it, in order that if the facts will warrant it a prosecution may be commenced against him.”

Letterbook copy (DNA: RG 59, DL, vol. 14). 1 p. Addressed to “Wm. Davis Esqr.” but no doubt intended for William Davies, the collector at Norfolk.

1The deposition (not found) was probably one of the enclosures in Davies to JM, 4 Feb. 1804 (PJM-SS description begins Robert J. Brugger et al., eds., The Papers of James Madison: Secretary of State Series (7 vols. to date; Charlottesville, Va., 1986–). description ends , 6:430).
