MS (DLC: TJ Papers, 191:34075); entirely in TJ’s hand; conjecturally dated based on TJ to George Hay, 1 Aug. 1810; one abbreviation faint.

TJ probably prepared this list of materials he wanted to use in his legal contest with Edward Livingston over the Batture Sainte Marie at New Orleans during a visit Claiborne made to Monticello about the beginning of August 1810. Claiborne transmitted it to New Orleans mayor James Mather, who sent TJ many of the requested items on 30 Nov. 1810.

mr derbigny pa. 26 refers to Pierre Derbigny, Réfutation du Mémoire en forme de consultation, Rédigé par Mr. Duponceau, Jurisconsulte a Philadelphie, au sujet des pretentions des Etats-Unis sur la Batture du Faubourg Ste.-Marie de la Nouvelle-Orleans (New Orleans, 1808; Sowerby, description begins E. Millicent Sowerby, comp., Catalogue of the Library of Thomas Jefferson, 1952–59, 5 vols. description ends no. 3492), 26. ordonnance des eaux et forets de 1669: Regulation of 1669 regarding waters and forests. du ponceau 25 refers to Peter S. Du Ponceau, Mémoire en forme de consultation, en réponse a celle de M. Derbigny, au sujet des prétentions du Gouvernement des États-Unis sur l’alluvion du Fleuve Mississipi, au devant du Faubourg Sainte-Marie, pres la Nouvelle-Orléans (New Orleans, 1808; Sowerby, description begins E. Millicent Sowerby, comp., Catalogue of the Library of Thomas Jefferson, 1952–59, 5 vols. description ends no. 3494), 25, which cites a work by the French author René Josué valin, Nouveau Commentaire sur l’Ordonnance de la Marine du mois d’août 1681 (La Rochelle, 1760). face au fleuve: “fronting the river.” Claiborne had sent TJ a copy of the resolution of the two houses of legislature of orleans on the day of its passage (Claiborne to TJ, 29 Jan. 1808 [DNA: RG 59, LCBNO]). The report of the case of j. gravier, along with derbigny’s 1st opinion. english (Case laid before Counsel for their opinion on the claim to the Batture, situated in front of the Suburb St. Mary) and the succeeding six entries described in the list above were issued without consecutive pagination as part of a single publication, Edward Livingston’s Address to the People of the United States, on the measures pursued by the Executive with respect to the Batture at New-Orleans (New Orleans, 1808; Sowerby, description begins E. Millicent Sowerby, comp., Catalogue of the Library of Thomas Jefferson, 1952–59, 5 vols. description ends no. 3484, 3493, 3495–8, 3502). examen de la sentence: [Louis Moreau Lislet], Examen de la Sentence rendue dans la Cause entre Jean Gravier et la Ville de la Nouvelle-Orléans (New Orleans, 1807; Sowerby, description begins E. Millicent Sowerby, comp., Catalogue of the Library of Thomas Jefferson, 1952–59, 5 vols. description ends no. 3483; authorship attributed to Moreau Lislet by TJ on 1809 Washington ed., Sowerby, description begins E. Possibly during the same visit to Monticello, Claiborne provided TJ with some brief comments on his statement on the Batture: “page 2—Act of Congress.—page 5—uses of the Batture see also petitions to Congress.—page 16.—The rise of the River, would not perhaps prove as injurious.—page 45—The Act of the Territorial Legislature too much relied on.—page 53. An agent of L. [i.e., Livingston] had actually filed a Claim with the Board of Commissioners.—page 58—Trial by Jury may be waiv’d by Consent of parties” (MS in DLC: TJ Papers, 192:34098; in Claiborne’s hand; undated; with an unrelated list of errata for Batture pamphlet in TJ’s hand on verso).
