Bond from David Higginbotham to William Short

2226 D  Know all men by these presents that I, David Higginbotham of the county of Albemarle and state of Virginia, am held and firmly bound unto William Short of the city of Philadelphia and state of Pensylvania in the sum of two thousand two hundred and twenty six Dollars & two thirds of the weight and fineness of those of the present standard of the United States, to be paid to the sd William his certain attorney, executors, administrators or assigns at the bank of Richmond in Virginia on or before the 25th day of December ensuing:1 to which paiment well and truly to be made, I bind myself, my heirs, executors and administrators firmly by these presents. Witness my hand and seal this 31st2 day of January one thousand eight hundred and thirteen.
1113. D.  The condition of this obligation is such that if the above bounden David, his heirs, executors or administrators shall pay unto the above named William his certain attorney, executors, administrators or assigns the just sum of one thousand one hundred and thirteen dollars & one third, of the weight and fineness above mentioned, at the bank of Richmond on or before the last day of April one thousand eight hundred and fourteen, with lawful interest from the 25th of December next preceding that date, until paid, then this obligation is to be void, or else to remain in full force

MS (ViU: TJP); in TJ’s hand, signed by Harrison as witness, canceled by removal of bottom section that presumably included Higginbotham’s signature; endorsed by Higginbotham: “D H. bd to W. Short paid $1113”; with notation by TJ on verso: “I expect the rent-note by mail in a fortnight.”

Enclosed with this bond and its covering letter were two similar obligations: (1) Bond from Higginbotham to Short, 31 Jan. 1813, nearly identical in wording to the bond printed above, except that Higginbotham acknowledged himself obligated to Short for $2,226 dating from 25 Dec. 1814, unless $1,113was paid to him by 30 Apr. 1815, with interest dating from 25 Dec. 1814 (MS in ViU: TJP; in TJ’s hand, signed by Harrison as witness, canceled by removal of bottom section that presumably included Higginbotham’s signature; endorsed by TJ: “Higginbotham to Short. } Bond”; with notations on verso, by Short: “I assign the within to Joseph & George Marx W Short Philadelphia Oct. 31. 1814” and, by an unidentified hand: “Receivd payment of Anderson & Blair Joseph & George Marx” and “Charged by us to a’ccts of David Higginbotham Novemr 5th 1814 A & B”). (2) Bond from Higginbotham to Short, 31 Jan. 1813, nearly identical in wording to the bond printed above, except that Higginbotham acknowledged himself obligated to Short for $1,693 dating from 25 Dec. 1815, unless $846 was paid to him by 30 Apr. 1816, with interest dating from 25 Dec. 1815 (MS in ViU: TJP; in TJ’s hand, signed by Harrison and Higginbotham, with Higginbotham’s signature canceled; endorsed by Short: “Higginbotham to Short.—} Bond for $846.66”; with notation by Short on verso: “Philadelphia May 4th 1816—The within bond having been satisfied by the payment of one hundred & seventy dollars as the balance remaining after the deduction of the amount of the 68. acres found to have been without the limits of the Indian Camp estate—I now return it to Mr Higginbotham by mail, first obliterating his signature W Short”).
