From Alexander Hamilton to Brockholst Livingston, 28 April [1797]

To Brockholst Livingston

[Albany] April 28 [1797]. “The situation of General Schuyler1 & other family circumstances do not permit me to attend Court this day. Will you do me the favour to argue the motion for setting aside the Non suit & granting a new trial on the inclosed case? …”2

The following entry appears in the minutes of the New York Supreme Court for April 28, 1797:

“Gilbert &
Ferguson
 vs.
Hallett
Argument. On Motion to set aside the
nonsuit in this cause, Mr Hamilton for the
Plaintiff and Mr Riggs for Defendant—
Curia Adversari vult.”
