The enclosures (10 pp.) are copies of (1) Lee to Benjamin Lincoln, 25 July 1805, enclosing a copy of his 15 June letter to Lincoln, and stating that since Captain Hooper had produced the required bonds, Lee had allowed him to depart for a Spanish port and from there to Boston; that he was enclosing a copy of the bond; and that on Hooper’s arrival Lincoln could decide on the case as he thought just; (2) Lee to Albert Gallatin, 17 June 1805, enclosing a copy of Lee’s 15 June letter to Lincoln, stating that he understood Hooper had written to the government on the matter, that others were urging Hooper to protest and to throw his ship on Lee’s hands, and that Lee hoped that on reading the enclosure Gallatin would approve his conduct; (3) Lee to Lincoln, 15 June 1805 (see PJM-SS, description begins Robert J. Brugger et al., eds., The Papers of James Madison: Secretary of State Series (10 vols. to date; Charlottesville, Va., 1986–). description ends 9:480 n. 1); (4) a 19 July 1805 bond for $4,000 signed by Benjamin Hooper, David Smith (who was then the captain of the Ranger), Joseph Nye Jr., and Penn Townsend, with an addendum by Lee, also signed by Hooper, Smith, Nye, and Townsend, ensuring that on arrival at Boston, Smith would deliver the Ranger and its papers to Lincoln, failing which, $2,000 of the stated funds would be paid to Lee for the use of the United States.
