From Alexander Hamilton to James Brice, 4 April 1792

To James Brice

Treasury Department April 4th 1792

Sir,

I was duly honored with your letter relative to the arrears of pay due to sundry Officers and Soldiers of the Maryland line of the late Army.1 The payments of arrears due to the lines of Virginia and North Carolina were made in the States under the special injunction of an Act of Congress which did not extend to Maryland or any other State.2 This circumstance will prevent the allowance of any Commission for the duty to any person in Maryland. It was expected to be performed at the Seat of Government by the Officers of the Treasury, but as it is desired by the executive of the State and it will be more convenient to the Claimants to receive their monies at Annapolis, I have written to the Commissioner of Loans3 to know whether it will be agreeable to him to receive the Money and to pay it as it shall be applied for. Mr. Campbell4 suggested that he was only intended to be the Bearer of the Money and that he understood it was afterwards to be placed in the hands of the Treasurer of Maryland5 who acts with his brother in his Office of Commissioner of Loans. I therefore hope that if the Commissioner undertakes the business your views will be satifactorily executed, while the monies of the United States will be placed in the hands of an officer duly responsible to them.

2H is referring to three joint resolutions of Congress, adopted on May 24, 1790, regarding the payment of arrears to the late officers and men of the Virginia and North Carolina lines (Journal of the House, I description begins Journal of the House of Representatives of the United States (Washington, 1826), I. description ends , 217–18, 221; Journal of the Second Session of the Senate of the United States of America Begun and Held at the City of New-York, January 4th, 1790; and in the fourteenth Year of the Independence of the Said States [New York, 1790], 79–81). The second of these resolutions reads as follows: “Resolved, That the President of the United States be requested to cause the Secretary of the Treasury to take the necessary steps for paying (within the said States, respectively,) the money appropriated by Congress, on the twenty-ninth day of September, one thousand seven hundred and eighty-nine, for the discharging the arrears of pay due to the troops of the lines of the said States respectively” (Journal of the House, I description begins Journal of the House of Representatives of the United States (Washington, 1826), I. description ends , 217).
